What Prosper Lake Homeowners Association's governing documents say
This document supplements the original Declaration of Covenants, Conditions and Restrictions (CCRs) for The Lakes of Prosper Homeowners Association, a single-family home community in Prosper, TX. It includes revised design guidelines (flags, solar panels, rain barrels, roofing) and administrative policies (records retention, payment plans, fee waivers). All homeowners are bound by these rules.
- Flag display: Only one flagpole per lot, max diameter 5 inches. Allowed flags: US flag, Texas flag, or official military flags. Freestanding poles must be silver with a silver or gold ball on top, at least 2 feet from property lines. Flags on freestanding poles max 4'x6'. Flags on attached poles max 3'x5'. No other pennants, banners, or kites visible from the street.
- Solar energy panels: Require prior ACC approval. Prohibited on common areas, association property, or if they extend beyond roofline, exceed fence height, void warranties, or cause unreasonable discomfort to neighbors. Allowed only on owner's roof or in fenced yard/patio. Ground-mounted panels require screening. Owner must submit site plan, drawings, manufacturer specs, and landscaping plans.
- Rain barrels: Permitted on owner's property but prohibited on common areas and between the front building line and the street. Preferred location is the rear yard. Must be an enclosed device, dark green, dark brown, or dark charcoal, or match home colors. Requires ACC approval with a photo/ cut sheet and a planting plan for screening.
- Roofing & gutters: Roofing must have at least a 30-year warranty, dimensional laminate or equivalent, fireproof, color 'Driftwood' by Oak Ridge. Shingles with wind/hail resistance or energy efficiency require ACC approval and must match surrounding properties. Gutters must match original trim/siding color; repainting requires approval.
- Records access & costs: Association retains records for 5 years (financial, minutes, contracts). Owner inspection available with prepaid costs: $0.10 per standard page, $0.50 per oversized, $1 per CD, $15/hr labor, $28.50/hr programmer, plus 20% overhead. Labor charged if request exceeds 50 pages. Confidential items not disclosed (violation history, financial info, contact info, personnel files).
- Payment plans for delinquent assessments: Association offers payment plans for delinquent amounts with a minimum 3-month term. A fee is charged to negotiate and administer the plan. All regular assessments due during the plan must be paid on time. Default triggers acceleration of the entire balance.
- Waiver of late fees & interest: Board may waive late fees/interest for extenuating circumstances. Requests must be submitted within 10 business days of the due date. Limit one waiver per owner in any 2-year period, and no waiver if owner defaulted on a payment plan in that time.
