What Twelve Oaks Homeowners Association, Inc.'s governing documents say
This is a set of governing documents for Twelve Oaks, a single-family homeowners association (HOA) in Prosper, Texas. The documents include a restrictive covenant from a 2004 new-home construction contract (binding the original owner and builder, not current residents), a 2010 amendment to the HOA's declaration, and several HOA guidelines. For current homeowners and buyers, the key rules cover construction timelines, solar panels, flags, and rain barrels.
- Construction deadlines & penalties: If you buy a lot and build, construction must start within 1 year of purchase and be completed within 9 months of the building permit. The HOA can charge $25 per day in liquidated damages for delays, unless the board grants an extension.
- Solar energy devices: Solar panels must be installed to minimize visibility from common areas, generally on roofs (not in front yards or on fences), and must match the roof slope and color. They can't reduce energy production by more than 10% compared to an alternative placement.
- Flag display: You may display permitted flags (U.S., Texas, military, etc.) up to 3'x5' in size. Attached flagpoles can be up to 6 feet long; free-standing poles must be 14-20 feet tall and placed in side or rear yards. Only one flag per attached pole, up to two on a free-standing pole. Flags must be kept in good condition and removed if no longer used daily.
- Rainwater recovery systems: Rain barrels are allowed but must be screened from street view unless the guttering makes that impractical. Barrels can't exceed 55 gallons, must be painted to blend in, and must have sealed openings. Overflow can't drain onto neighbors' property.
- What this document doesn't cover: These are partial documents—they don't include the full HOA rules on pets, parking, leasing, or other typical restrictions. The 2004 covenant is a construction contract between the original owner and builder, not a rulebook for residents.
