It creates an owners' association (Oak Lake Patio Homes, Inc.) that manages common areas, enforces rules, and provides exterior maintenance. The rules bind all lot owners, and leases must include provisions making renters subject to the declaration.
- What you own & maintain: You own your lot and the interior of your patio home; the association maintains the exterior of all homes, including roofs, gutters, exterior surfaces, and landscaping, but not glass surfaces, enclosed patios, fenced yards, window/door fixtures, air conditioning equipment, or owner-planted landscaping.
- Assessments & fees: The maximum annual assessment starts at $85 per lot, and can rise up to 120% per year without a vote. Any higher increase or special capital improvement assessment requires written approval from two-thirds of each voting class. - Leasing & rentals: Any lease must be in writing and must state that the lease is subject to the declaration, bylaws, and articles of incorporation, with violations constituting default. Owners may delegate their common-area rights to tenants who reside on the property.
- Party walls: Walls built on lot dividing lines are party walls. Repair and maintenance costs are shared equally among owners who use them. If an owner's negligence causes damage, that owner bears the cost of weatherproofing.
