What Windham Farms's governing documents say
Windham Farms is a single-family residential subdivision in Collin County, Texas, governed by a Homeowners Association (HOA) created by these Covenants, Conditions, and Restrictions (CC&Rs). All owners of lots in the subdivision are members of the Windham Farms Association. The rules apply uniformly to all lots and focus on property upkeep, construction standards, and land use.
- Dwelling requirements: Dwellings must be site-built, at least 1,500 sq. ft. in living area, and have a roof pitch of no less than 6/12. Mobile homes and manufactured homes are not allowed. Outbuildings must be located at least 30 ft. behind the main dwelling.
- Livestock & Animals: A maximum of 4 livestock animals per 1.0 acre may be kept on a tract. All animals must be confined to the owner's property and not be a nuisance. No poultry or other wire fencing (including chain link) is allowed along road frontage.
- Vehicles & Junk: No motor vehicles without current license plates and inspection stickers may remain on a premises for more than 10 days. No tract may become a junk yard, as determined by two-thirds of owners in writing. No dumping of rubbish; trash must be kept in sanitary containers.
- Architectural Review: An Architecture Review Board (initial members: Roger Liudahl, Mark Ragon, Claude E. Hearn) must approve all building plans before construction. Plans not responded to within 30 days are deemed approved. The Board may reject plans that do not meet restrictions.
- Assessments: The Association may levy annual general assessments for operation, maintenance, and reserves. Each tract is one assessable unit. The initial annual rate per tract is not to exceed $2.00 if the Developer still owns 20% or less of the subdivision. Changes require a two-thirds vote of membership.
- Use Restrictions: Tracts may be used only for residential purposes; no business activity allowed on the property. Outside toilet facilities are prohibited; sewage systems must meet local and state health regulations. Nothing may be done that becomes a nuisance.
- Enforcement & Duration: Covenants run with the land for 30 years from the date recorded, automatically renewing for 10-year periods unless terminated by two-thirds majority of tract owners. Any owner may enforce violations through legal proceedings. Invalidation of one covenant does not affect others.
