What Holiday West's governing documents say
Hudson Apartments is a rental apartment community in North Richland Hills, TX, governed by a Regulatory Agreement that imposes affordable housing covenants on the owner/landlord. This document is not a standard HOA rulebook; it binds the property owner to income and rent restrictions in exchange for bond financing, ensuring units are affordable to low- and moderate-income households. The rules here apply to the landlord, not directly to tenants, but they shape who can live there and what rents are charged.
- Affordability — Income limits: At least 90% of units must be leased to households earning no more than 140% of Area Median Income (AMI), and at least 50% of units must be leased to households earning no more than 80% of AMI (Tarrant County AMI, adjusted for household size). Tenants must provide annual income certifications.
- Rent restrictions: Rent for income-restricted units is capped based on 30% of the applicable income limit (140% or 80% of AMI) divided by 12, using the Novogradac Rent & Income Limit Calculator. Actual rent may be lower if a tenant uses a Housing Choice Voucher.
- Housing Choice Vouchers: The landlord must accept Section 8 Housing Choice Vouchers and cannot discriminate based on source of income. For voucher holders, the minimum income requirement is 2.5 times the tenant's portion of rent (not covered by the voucher).
- Lease & occupancy rules: All units must be rented as multifamily residential on a continuous basis. Leases must include a clause that income is subject to annual recertification; misrepresentation may result in lease termination. Landlord cannot evict a tenant solely to meet income targets.
- Term & enforceability: The Regulatory Agreement runs until the end of the ground lease or other termination event (e.g., foreclosure, condemnation). It is a covenant running with the land and binds future owners. Default allows the housing finance corporation to seek injunctive relief and legal fees.
- What this document doesn't cover: This document does not address typical HOA rules such as pets, parking, noise, architectural changes, or common area maintenance. It also does not cover tenant responsibilities beyond income certification. For such rules, refer to the lease agreement.
