- Mandatory arbitration: Any dispute arising from the purchase, construction, or repair of the home, or relating to the property, must be resolved by binding arbitration under the Federal Arbitration Act. The arbitration is administered by the American Arbitration Association under its Construction Industry Arbitration Rules. The builder can join subcontractors in the arbitration.
- Jury waiver: If any claim is brought in court, both parties waive the right to a jury trial. This applies even if arbitration is not pursued.
- Attorneys' fees: If the builder is a prevailing party in any legal or arbitration proceeding related to the property (e.g., enforcing the contract or defending claims), the owner (and future owners) must pay the builder's costs, expert fees, and reasonable attorney's fees. The builder may also recover fees for enforcing this declaration.
- Term and expiration: The covenant lasts 15 years from the closing date (December 8, 2017), then automatically expires — except for arbitration proceedings already in progress. However, if the builder or an affiliate reacquires title, the declaration terminates immediately.
