North Fork Estates is a single-family residential subdivision in Saginaw, TX, governed by private land use regulations (restrictive covenants) that run with the land and bind all lot owners. These rules control architectural design, building size, use, and maintenance to preserve the community's character.
- Architectural review: All plans for buildings, structures, or improvements must be submitted to an Architectural Committee for approval, with decisions made within 10 days of submission. The committee can waive or modify rules if it doesn't harm architectural harmony.
- Building size & materials: Minimum living area: 1,800 sq ft for lots ≤1.25 acres (54,450 sq ft), 2,000 sq ft for larger lots. Two-story homes: at least 1,500 sq ft ground floor and 2,400 total. Exterior walls must be at least 60% masonry (stone, brick, stucco). Roof pitch subject to committee approval; metal roofs prohibited on main buildings.
- Parking & vehicles: House trailers, motor homes, campers, boats, and similar vehicles must be stored behind the rear building line, out of sight. No on-street parking for more than 24 hours. All vehicles must be currently licensed and operational. Garages must accommodate two cars.
- Pets & horses: No swine, poultry, cows, sheep, goats, or other livestock (except horses) allowed. Horses limited to one per acre, for non-commercial use. Pets must be vaccinated and never run unleashed. If pets or horses become a nuisance, they must be removed upon written demand.
- Use restrictions: Lots are for single-family dwellings only. No commercial activity, no further subdivision, no mineral exploration, no firearms discharge. No temporary structures or trailers used as residences. No garage apartments or outbuildings rented to the public.
- Maintenance & upkeep: Each lot owner must keep the lot and improvements maintained, including mowing grass, removing trash, and maintaining the area between pavement and lot line. Failure allows the committee to perform work and charge the owner, plus interest at 18% per annum and a $100/day penalty for violations.
- Entry improvement cost sharing: Street lighting, screening walls, and landscaping along certain roads (Entry Improvements) may be maintained by lot owners. If 51% of lots petition, all owners pay a pro rata share, secured by a lien on the lot subordinate only to first mortgages and property taxes.
- Duration & amendment: Regulations last 25 years from 1997, auto-renewing for successive 10-year periods unless terminated or amended. After 5 years, they may be amended by 75% of lot owners (excluding developer lots); before 5 years, developer consent needed.
