What Heartland 6A's governing documents say

It is NOT a full set of community-wide rules. Instead, it binds the current and future owners of a specific lot to dispute resolution (mediation/arbitration), warranty limits, and a mold release. - Dispute resolution: arbitration required: Any dispute between the owner and builder (including contract, warranty, tort, or personal injury claims) must first go to mediation, and if unresolved, to binding arbitration under the Federal Arbitration Act. The arbitration is conducted by a single arbitrator, and the owner is not initially required to pay costs exceeding those of a court filing.
- Warranty limitations & waiver of implied warranties: The only express warranty from the builder is a written limited warranty. By signing, the owner waives any implied warranty of good and workmanlike construction (to the extent it exists in Texas). The builder may repurchase the property if repair costs exceed 20% of fair market value.
- Mold & biological impurities release: The owner releases the builder from all claims related to mold, mildew, fungus, chemicals, or biological impurities, including personal injury, property damage, and adverse health effects. The owner also agrees to obtain waivers of subrogation from insurers.
- Binding on successors: The agreement runs with the land, meaning future owners of the property are bound by its terms.
