What Cypress Point Est's governing documents say
Cypress Point Estates is a single-family home subdivision in The Colony, TX (Denton County), governed by deed restrictions that run with the land. There is no homeowners association or mandatory fees; the rules are enforced by lot owners. This document defines what you can build, how you can use your property, and what is prohibited.
- Residential use & occupancy: Each lot is for one detached single-family home, no more than two stories. Occupancy limited to one family (related by blood, adoption, or marriage) OR no more than two unrelated persons living as a single housekeeping unit, plus household servants.
- Garage & parking: Each home must have a garage for 2–3 cars; carports are banned. No boats, RVs, travel trailers, or similar vehicles may be parked in the driveway or front yard, and must be concealed in side/rear yards. Trucks over 1 ton and vehicles with painted ads cannot park overnight (except during construction). No inflammatory/explosive cargo vehicles allowed.
- Pets: No livestock or poultry. Up to four household pets (dogs, cats) per lot. Pets must be confined to owner's rear yard behind a fence or inside the house; lot must be kept free of pet waste. Animals must be tagged.
- Prohibited activities: No business, commercial, or manufacturing uses. Quiet in-home activities like tutoring or art lessons are allowed if they don't increase street parking or disturb neighbors. No oil drilling, mining, or temporary dwellings (except builder's trailers during construction). No clothes drying in public view. No burning except in fireplaces or outdoor cooking.
- Construction & architecture: Minimum floor area per city requirements. Exterior materials and roofing must meet city standards. Setbacks per plat or city. Fences must be masonry, brick, or wood; max 8 ft (or less if city requires); chain link is banned. No fence extends beyond the front building line. Mailboxes must be approved. No building moved onto a lot (new construction only). Antennas (except AM/FM/TV) require written permission and must be in attic or roof-mounted with max 5 ft extension.
- Lot maintenance & easements: Owners must mow weeds/grass (max 6 inches), maintain attractive ground cover, and edge street curbs. No vegetables in street-facing yards. Easements must be kept clear. If owner fails to maintain, declarant may cut vegetation and bill owner (no lien). Exterior of buildings must be kept in good repair.
- Term & amendments: Covenants run for 30 years from recording (1997) and auto-renew every 10 years unless amended. Declarant may amend while owning lots; otherwise, owners of >50% of lots can amend, but not without declarant's joinder for the first 10 years.
- Enforcement & notices: Any lot owner may enforce these restrictions. Failure to enforce does not waive future rights. Notices to owners go to lot street address; notices to declarant go to its recorded address.
