Gills Crossing Phase II is a single-family subdivision in Johnson County, TX, with covenants running with the land. These rules apply to lot owners and restrict land use, building size, homes, animals, vehicles, and nuisances.
- Land use & dwellings: Lots are for single-family residential use only. One residence per lot; no outbuildings, RVs, or mobile homes as main dwelling. Site-built homes must be at least 1,400 sq ft (excl. porches/garage). Manufactured homes must be double-section or larger, new, with front door facing street, and must have a front porch (min. 24 sq ft) with handrails, and be skirted within 30 days with cement fiberboard (no metal/vinyl/wood lattice).
- Animals & livestock: Large animals (livestock/horses) limited to 1 per acre. Up to 3 cats and/or dogs allowed per property. Vicious breeds (pit bull terriers, Rottweilers, Doberman pinschers) prohibited. No fighting roosters, swine, breeding/kenneling (commercial or otherwise), or wild animals. Animals must be kept in fenced area or on a leash.
- Parking & vehicles: All vehicles must have current registration and inspection; no street parking. Tractor-trailer rigs cannot operate on subdivision roads or be parked on lots, but tractors without trailers may be parked behind the residence, not visible from the street. No junk yards, wrecked cars, or inoperative vehicles.
- Nuisances & property maintenance: No noxious/offensive activities; no accumulation of trash, rubbish, or junk. Yard/garage sales limited to 2 consecutive days. No industry, pipeline yards, or businesses producing odor, fumes, dust, noise, or vibrations.
- Septic systems: Each lot with a dwelling must have a county-approved, permitted septic system installed by a licensed Texas installer. Aerobic systems require a service contract maintained by the property owner.
- Setbacks & easements: Front building line: 40 ft; side and rear: 20 ft. Utility easements: 10 ft along front/rear lot lines; 5 ft centered on interior side lot lines. Drainage easements must be kept free of weeds and debris by the lot owner.
- Developer rights & amendments: Developer may approve dwelling location, grant variances, re-plat unsold portions, and amend covenants without consent until 50% of lots sold. After 25 years, covenants auto-renew for 10-year periods unless 3/4 of owners vote otherwise.
- Enforcement & duration: Covenants run with the land for 25 years from Nov 21, 2007, then auto-renew for 10-year periods. Violations may be prosecuted by any lot owner at law or in equity. Not enforced by Johnson County Commissioners Court.
