This is a declaration of covenants, restrictions, and easements for a single-family residential subdivision (Pleasant Run Addition) in Johnson County, Texas. It applies to all lot owners and residents and is enforced by the developer (Declarant) and other lot owners; no homeowners' association or monthly assessments are created by this document.
- Residential use & structures: Each parcel may contain only one single-family residence. Manufactured, prefabricated, or factory-built homes are permitted with Declarant approval. Minimum home size is 1,000 square feet of air-conditioned area. Construction must be completed within 60 days (manufactured) or 6 months (site-built).
- Setbacks & location: Buildings must comply with Johnson County regulations: 40-foot front setback, 10-foot side and rear setbacks measured from property lines. Homes must be set back 40 to 50 feet from the front property line unless written approval is obtained from Declarant.
- Outbuildings & fences: Outbuildings (barns, garages, storage sheds) and play equipment must be placed in the backyard and require Declarant approval. Fencing along roads must be wire with metal posts, pipe and sucker rod, pipe and cable, or chain link (painted). No wood stockade fences allowed on road frontage or in front yards.
- Vehicles & parking: No commercial vehicles, buses, trailers, RVs, boats, or equipment may be parked in the front yard or within 50 feet of a side property line unless enclosed and hidden from view. Automobiles and small passenger trucks in good repair are allowed. All streets are off-limits to parking. Driveways must be at least 10 feet wide and 50 feet long.
- Animals: Swine are prohibited. No commercial feed lots or kennels. Horses, livestock, fowl, and dogs must be confined by fence or leash. Limit of one animal unit per acre (excluding cats and dogs). Animals may not run at large.
- Prohibited activities & nuisances: No dirt bikes, ATVs, shooting ranges, or firearms. No oil/gas drilling or mining. No commercial wrecking yards or auto repair. No nuisance or offensive activity. Grass must be kept mowed below 10 inches.
- Signs & antennas: No commercial signs. Temporary sale/garage sale signs limited to 3' x 3'. Antennas and satellite dishes must be located in the backyard only.
- Duration & enforcement: These covenants run for 20 years from recording, automatically renewing for successive 10-year periods. They may be terminated by a 66.7% vote of affected owners. The Declarant or any owner may sue for injunctive relief and recover costs including attorney's fees.
