What Camilla Estates's governing documents say
Camilla Estates is a single-family home subdivision in Kaufman County, TX, governed by deed restrictions recorded by the developer (Grantor). These restrictions apply to all lot owners and are designed to protect property values, with enforcement by the Grantor or a future homeowners association (formed when 75% of owners agree). The restrictions run with the land for 10 years from recording (October 2020), then automatically renew for successive 10-year periods unless amended.
- Use & occupancy: Lots may be used only for single-family residential purposes. Occupations are permitted only if conducted entirely within the dwelling or a Grantor-approved shop and do not interfere with neighbors.
- Building setbacks & placement: All homes must be set back between 50 and 150 feet from the front property line, parallel to the roadway, and centered on the lot. Any home set back more than 150 feet requires written approval from the Grantor or Association.
- Manufactured homes: Manufactured homes must be no more than 12 years old at placement (older homes require Grantor or Association approval). They must have foundations, be skirted within 45 days (or 90 days in some sections), and have a wood-like or brick-like exterior appearance and a front porch within 90 days of moving onto the lot.
- Vehicles & parking: No truck, bus, or trailer may be parked on the street in front of a property (except for construction or repair equipment while work is occurring). No junk cars (vehicles without current inspection or license plates) are permitted on any lot.
- Pets & livestock: Dogs, cats, and other domestic household pets are allowed provided they are properly leashed. No fighting game hens, roosters, pigs, or swine are allowed. Livestock is limited to one adult head per acre of property owned, and the total number of animals per household shall not exceed six.
- Temporary structures & signs: No camper, motor home, travel trailer, or temporary structure may be used for living on a temporary or permanent basis. Only homes larger than 16 square feet may be placed or maintained as outbuildings. Billboard or advertising signs are prohibited except temporary signs placed by the Grantor during sales, which must be removed within 10 days of closing.
- Enforcement & duration: The restrictions are enforceable by the Grantor, Association, or any Owner for 10 years from the recording date (October 2020), then automatically extend for successive 10-year periods. Violations must be corrected within 30 days of certified mail notice. The Grantor retains exclusive amendment power until 100% of lots are sold; after that, amendments require 70% of lot owners. Prevailing parties in enforcement lawsuits may recover attorney fees.
