What Lavendale Circle's governing documents say
This is the bylaws of the Lavendale Circle Addition Homeowners Association, a single-family subdivision HOA in Dallas, Texas. It establishes the governance structure — membership classes, board of directors, officers, meetings, and assessments — and applies to all lot owners in the subdivision.
- Membership & voting: Each lot owner (excluding developer) is a Class A member with one vote per lot. The developer holds Class B membership with three votes per lot until the association has six or more Class A votes or January 1, 1977, whichever comes first. Proxies are allowed but expire after 11 months.
- Board of Directors: The board manages the corporation, with at least one director elected by members at the annual meeting. Directors need not be residents or members. A majority constitutes a quorum; vacancies are filled by remaining directors.
- Meetings: Annual member meetings are held the third Tuesday of January at 1:30 PM. Special meetings can be called by the president, board, or upon written request of members holding 1/4 of votes. Notice must be given 10–50 days in advance. A quorum is 1/4 of votes.
- Assessments: The board fixes annual assessments at least 30 days before each period and notifies owners. Assessments are a lien on each lot. Proceeds are used for common property maintenance and related activities.
- Common Properties & Use Rights: Members have use rights to common properties as defined in the Declaration. They may delegate rights to family residents and guests, subject to board-adopted rules.
- What this document doesn't cover: These bylaws do not contain specific rules on leasing, pets, age restrictions, architectural control, parking, or other typical HOA restrictions. Those would appear in the separate Declaration of Covenants, Conditions, and Restrictions (CC&Rs).
