What Ak-Chin Homes I's governing documents say
Ak-Chin Homes I is a 37-unit affordable rental community on tribal land in Ak-Chin Village, AZ, built with federal low-income housing tax credits. This document is a regulatory agreement between the owner and the Arizona Department of Housing, not a set of rules for residents. It binds the landlord to keep most units affordable for households earning up to 60% of area median income (AMI), with specific set-asides for very-low-income tenants (20–50% AMI). The affordability restrictions run until at least 2037.
- Affordability & income limits: All 37 units are rent-restricted: at least 4 units for households at or below 20% AMI, 4 at 30% AMI, 8 at 40% AMI, 4 at 50% AMI, and the remaining 17 at 60% AMI. Income is recertified annually, and if a tenant's income rises above 140% of the limit, the unit remains counted if a similarly sized unit is rented to an eligible tenant.
- Lease protections & eviction: Tenants cannot be evicted without good cause. Leases must be year-to-year or longer, and the owner cannot deny tenancy because an applicant holds a Section 8 voucher. Rent increases are limited by Section 42 of the Internal Revenue Code.
- Non-discrimination: The owner agrees not to discriminate on the basis of race, creed, color, sex, age, handicap, marital status, or national origin in leasing or employment, except where noted in the state preference restrictions.
- Pets & amenities: This document does not cover pet policies, parking, or day-to-day rules. Amenities listed in the agreement include ranges, refrigerators, air conditioning, washer/dryer hook-ups, garages (7 units), play areas, large yards, and some covered parking.
- What this document doesn't cover: This is a landlord regulatory agreement, not a resident handbook. It does not address pet limits, quiet hours, guest policies, maintenance responsibilities, or parking enforcement. Those rules, if any, would be in the individual lease or a separate community policy.
