This is a covenant document for Maricopa Groves, a new-home community in Pinal County, AZ, that requires all property owners to be members of the Central Arizona Groundwater Replenishment District (CAWCD). It imposes mandatory assessments and fees to secure a water supply for the community. This is not a full set of HOA rules; it only covers groundwater replenishment obligations.
- Groundwater replenishment membership: All parcels in Maricopa Groves Units I and II are automatically members of the Central Arizona Groundwater Replenishment District, binding owners to pay replenishment assessments and fees.
- Replenishment assessment: An annual assessment is levied by CAWCD on each parcel based on its Parcel Replenishment Obligation (the amount of Excess Groundwater used). Unpaid assessments become a lien on the property.
- Replenishment reserve fee: For parcels qualifying as Category 1 member land, a one-time fee must be paid to CAWCD before a public report is issued authorizing sale or lease. The fee equals twice the Replenishment Reserve Charge times projected annual Excess Groundwater demand.
- Lien and personal obligation: The replenishment assessment and reserve fee create a continuing lien on the parcel and a personal obligation of the owner at the time the assessment came due. CAWCD may enforce collection as provided by Arizona law.
