This Declaration of Covenants, Conditions and Restrictions binds the owner/landlord to federal and state affordable housing program rules—it is NOT a handbook of resident rules. It restricts who can live here based on income and age, sets maximum rents, and gives tenants strong protections against eviction and unfair lease terms.
- Affordability & income limits: At least 15 units are State-Assisted Units reserved for households earning no more than 30% of the area median income. All 200 units are rent-restricted, with maximum rent for a one-bedroom at $526/month and two-bedroom at $631/month (gross rent including utilities, subject to annual ADOH approval). Tenants must recertify income annually.
- Age restriction (55+): 15 State-Assisted Units must be occupied by households where at least one member is 55 years or older. The rest of the project may follow the same age restriction as implied by the name 'Senior Apartments' but the document only requires the 15 units to be senior.
- Lease terms & renter protections: Leases must be in writing for a term of at least 12 months. Tenants cannot be evicted without cause; good cause excludes income increases. Prohibited lease terms include waivers of jury trial, right to appeal, or agreement to be sued. Owner must provide 30 days' notice before termination.
- Tenant selection & fair housing: Owner must adopt written tenant selection criteria, maintain a waiting list in chronological order, reject applicants only for legitimate reasons, and affirmatively market units to all eligible persons regardless of race, color, religion, sex, disability, or national origin. - Rent increases & oversight: Annual rent increases must be approved in writing by the Arizona Department of Housing (ADOH). Over-income tenants (those whose income rises above limits) must pay 30% of adjusted income for rent, but no more than fair market rent.
- Unit features & amenities: The project consists of 200 units: 156 one-bedroom and 44 two-bedroom. Amenities include carports and uncovered parking, community room, fitness center, security cameras, free WiFi in common areas, a no-smoking policy inside buildings, and designated outdoor smoking areas.
