What Home @ Maricopa's governing documents say
This document is a Declaration of Property Development Restrictions recorded by the developer (Declarant) for Lot 1 in the Home @ Maricopa mixed-use project. It controls what improvements and landscaping can be built on this lot, but the restrictions are enforceable only by the developer (not by any homeowners association or other owners). The document will terminate automatically 25 years after recording or when initial construction is completed, whichever occurs first.
- Improvement & landscaping approval: All buildings and landscaping visible from streets must receive prior written approval from Declarant, who has 5 business days to respond. Approval is deemed given if not rejected within that time and cannot be unreasonably withheld. Major changes—such as altering unit count, floor area, or land use—require resubmission.
- Enforcement & rights: Only Declarant (or its assignee) may enforce these restrictions. No property owners' association or other lot owner has any enforcement right. Disputes are subject to arbitration, and the prevailing party in any legal proceeding may recover attorneys' fees.
- Duration & termination: The restrictions last until the earlier of 25 years after recordation (June 7, 2047) or the date construction is completed on the entire Property. Declarant alone can terminate at any time; amendments require written consent of both Declarant and the property owner(s).
