It is not a complete set of community rules; it only addresses water-related assessments and liens.
- Groundwater replenishment assessment: Each parcel is subject to an annual Replenishment Assessment based on the Parcel Replenishment Obligation, set by CAWCD to fund groundwater replenishment. Nonpayment results in interest, costs, penalties, and a continuing lien on the parcel.
- Activation fee: An Activation Fee, equal to CAWCD's per-unit fee multiplied by the number of housing units on the parcel, must be paid by the owner before a public report authorizing sale or lease of subdivided lands is issued.
- Replenishment reserve fee: Category 1 member land parcels are subject to a one-time Replenishment Reserve Fee, based on projected Excess Groundwater demand, payable before a public report for sale or lease. Long-term storage credits may be assigned in lieu of cash payment.
- Lien and personal obligation: The Replenishment Assessment, Activation Fee, and Replenishment Reserve Fee create a continuing lien on the parcel and are a personal obligation of the owner at the time the fee came due.
- Amendments: This declaration may be amended only with the written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total property area, or by changes in applicable statutes.
