This is a Supplemental Declaration of Covenants and Restrictions for a commercial lot within the Maricopa Power Center shopping center (The Wells). It governs a specific parcel intended for a Walgreens drugstore, not a residential community. This document sets rules for the landowner (Maricopa WG LLC) regarding use, construction, and potential repurchase by the developer. - Building size & height: Any building on the Owner Parcel cannot exceed 15,000 square feet floor area and 24 feet in height (except the pre-approved Walgreens building may be up to 30 feet tall).
- Repurchase right (developer): If the owner fails to commence construction of the Walgreens by July 1, 2009, or complete by May 1, 2010, the developer may elect to repurchase the parcel at a price determined by agreement or appraisal (lesser of original purchase price or fair market value, plus actual improvement costs).
- Maintenance during construction: The owner must maintain the parcel in a clean condition, free of dust and debris, and kept planted with grass/decomposed granite, irrigated and mowed consistent with first-class operation of the shopping center.
