It exclusively governs dispute resolution between homeowners and the builder for construction-related claims. It is not a full community ruleset; it only mandates a step-by-step process of notice, mediation, and binding arbitration before any lawsuit can be filed.
- Mandatory dispute resolution steps: Before any lawsuit against the builder, an owner must: (1) send a written notice describing the claim, (2) allow the builder 35 days to inspect, (3) allow 90 days to cure, (4) attempt negotiation, (5) submit to mediation under AAA rules, and (6) if unresolved, submit to binding arbitration. These steps are conditions precedent to litigation.
- Mediation process & costs: If negotiation fails, either party may initiate mediation through the American Arbitration Association (AAA). The builder pays for one day of mediation (mediator and administrative fees); additional costs are split equally. Each party bears its own attorney fees. Mediation must occur before arbitration unless waived.
- Binding arbitration process & fees: Unresolved claims go to binding arbitration under AAA rules. For claims >$250,000 or seeking punitive damages, three arbitrators hear the case; otherwise one. Filing fees: the filing party pays the first $750; the builder pays the next $2,000 if the owner participated in mediation (or if waived, or builder is filer). Remaining fees are shared equally.
- Claims covered by these restrictions: Applies broadly to any dispute, claim, or controversy between an owner and builder relating to the home or parcel, including contract, warranty, tort, property damage, or personal injury. It does not cover consumer product claims under the Magnuson-Moss Act. The builder can also include its affiliates, contractors, and insurers in the process.
