What The Properties's governing documents say
The Properties is a single-family residential subdivision in Ak-Chin Village, AZ, governed by a set of deed restrictions (Covenants, Conditions & Restrictions). Each homeowner owns their lot and home; there is no homeowners' association or mandatory assessments under this document. The restrictions are enforceable by neighboring property owners within 1,200 feet.
- Private residential use: Dwelling units may only be used as a single-family residence for the owner, family, tenants, and social guests. No other uses are permitted.
- Lot and home size: Minimum lot size is 1.25 acres, and no lot may be subdivided smaller. Only one home per lot is allowed. Homes must have a ground floor area between 3,300 and 6,000 square feet (excluding porches, garages, etc.). Two-story structures are prohibited; basement homes are allowed.
- Leasing & rentals: Owners may lease their dwelling unit, but the lease must be in writing for a term of at least 30 days. The lease must require the tenant to comply with all governing documents.
- Vehicles & parking: All motor vehicles must be stored in a garage or carport when possible. Recreational vehicles, commercial vehicles, motor homes, campers, trailers, and boats are prohibited except for short-term loading/unloading. Trucks with a camper shell meeting size limits are allowed if used for regular transportation. Off-road driving is prohibited.
- Pets & animals: No horses, mules, zebras, or any animal larger than a normal dog are permitted. Enclosures for horses are not allowed. The document does not restrict common domestic pets like dogs or cats, but they may be subject to other rules.
- Architectural & design review: The initial dwelling unit must be designed by an Arizona licensed architect and constructed by a licensed contractor. Home design and materials must be approved by Dean Drosos L.L.C. (or a successor appointed by Declarant). All homes must conform to the declared vision.
- Fences & walls: Exterior walls (fences) may not exceed 6 feet high on sides and rear, and no more than 4 feet high in the front. Side walls may extend no more than 15 feet from the home, and rear walls no more than 50 feet from the back.
- Roofing: Roofs visible from the street must be tile or steel. Asphalt-based or wood composite roofs are prohibited where visible from the street.
