What Maricopa Meadows's governing documents say
Maricopa Meadows is a master-planned community in Ak-Chin Village, AZ. These documents are supplementary and tract-specific declarations that add to the community's Master Declaration. They apply to specific lots (Parcel 14 and Parcel 11, Lots 1-114) and primarily address a builder's limited warranty and mandatory arbitration for construction-related disputes. They do not contain the full set of community rules.
- What these documents cover: The First Supplementary Declaration annexes additional lots (Parcel 14) into the master association. The Tract Declaration (Lots 1-114 of Parcel 11) establishes a home builder's limited warranty and alternative dispute resolution procedures, including binding arbitration, for disputes with the tract declarant.
- Home warranty coverage: The builder provides a limited warranty against construction defects for the home and common elements, with coverage periods as shown on a validation form. The warranty disclaims all other warranties and limits liability to the amount on the form. Repairs, replacement, or payment for diminution in value are at the builder's option.
- Dispute resolution & arbitration: All disputes with the tract declarant (including construction defects) must go through binding arbitration, waiving the right to a jury trial. Before arbitration, you must give written notice and allow a 60-day cure period. The Master Association must obtain 51% owner approval before filing a claim. Arbitration is governed by the Federal Arbitration Act.
- Relationship to Master Declaration: The Master Declaration of Maricopa Meadows controls if there is a conflict, except that the dispute resolution procedures in the Tract Declaration replace those in the Master Declaration for lots in the tract. The tract declaration can only be amended with 67% of tract owner votes and tract declarant approval.
- What this document doesn't cover: These documents do not contain typical community rules such as pet restrictions, leasing limits, parking regulations, architectural guidelines, or age restrictions. Those rules are in the Master Declaration, which is not provided here.
