This is a commercial shopping center (Fry's Food and Drug Place) at Highway 60 & Phelps Drive in Apache Junction, AZ. The document governs owners and occupants of retail/commercial lots, not residents. It sets use restrictions, exclusive rights for the grocery store (Fry's), and shared maintenance obligations for common areas like parking and landscaping.
- Permitted & prohibited uses: Lots must be used as a first-class retail/commercial shopping center. Prohibited uses include theaters, churches, health clubs, bars (except as part of restaurants), adult businesses, and funeral parlors. Certain uses (restaurants, offices, drive-throughs) require prior written consent from the grocery store owner/occupant.
- Grocery store exclusives: Only the grocery store parcel (Lot 4) may operate a supermarket, drugstore, or pharmacy. Other lots cannot sell groceries, pharmaceuticals, or package liquor (except convenience stores on Lot 1 and small specialty food shops with incidental liquor sales).
