This document is a restrictive covenant recorded in 2010 that limits the future use of a specific parcel (Lots 267-282 and part of Tract C in Arroyo Vista Unit 2) to either an elementary/middle school (K-8) or single-family residential homes. It is not a full set of HOA or condominium rules but a land-use restriction that runs with the property, benefiting neighboring lots owned by the Grantee (Lots 217–266 and 283–509). The covenant applies to the property owner (Grantor) and may be enforced only by the Grantee or its developer assigns.
- Land use & restrictions: The property may be used only for: (a) a school serving kindergarten through grade 8 (with related ancillary uses), or (b) single-family homes. No other uses, such as commercial, multi-family, or grades 9–12, are allowed.
- Who enforces & duration: Only the Grantee (Val Vista Centers, Inc.) or a 'Grantee Developer Assignee' (a purchaser of portions of the Grantee's property for development, not individual lot buyers) may enforce this covenant. It automatically terminates when neither the Grantee nor any Grantee Developer Assignee owns any portion of the benefited property (Lots 217–266 and 283–509).
