This document is an ancillary covenant for the Sandia-NW community in Arizona City, AZ, that establishes membership in the Central Arizona Groundwater Replenishment District (CAWCD). It binds all property owners to pay water replenishment fees and assessments to help the development qualify for a certificate of assured water supply. It is not a full set of community rules; it only covers water-related obligations.
- Replenishment Assessment: Each parcel is subject to an annual Replenishment Assessment based on its Parcel Replenishment Obligation, levied by CAWCD. Nonpayment results in a lien on the parcel and personal liability for the owner.
- Activation Fee: A one-time Activation Fee is due before a public report is issued allowing sale or lease of subdivided lots within the property. The fee is set by CAWCD per housing unit.
- Replenishment Reserve Fee: A Replenishment Reserve Fee is imposed on Category 1 member land, based on projected annual excess groundwater demand. It must be paid prior to a public report, or long-term storage credits may be assigned instead.
- Owner Reporting of Water Deliveries: If an owner delivers groundwater to a parcel, they must file an annual report with Woodruff Water Company by February 20, detailing the amount delivered per parcel and the total.
- Lien and Personal Obligation: Each owner covenants to pay the Replenishment Assessment, Activation Fee, and Replenishment Reserve Fee. These obligations constitute a continuing lien on the parcel and a personal debt of the owner when due.
