What Sandia-Se1's governing documents say
This document is a Declaration of Covenants, Conditions and Restrictions for the Sandia-SE1 subdivision in Pinal County, Arizona, concerning membership in the Central Arizona Groundwater Replenishment District (CAWCD). It binds all property owners to certain water replenishment obligations, fees, and reporting requirements. This is not a standard HOA rulebook; it only covers groundwater replenishment-related covenants.
- Water replenishment obligations: Each parcel is subject to a Replenishment Assessment based on its Parcel Replenishment Obligation, which is calculated from groundwater deliveries and excess groundwater usage. Owners must pay these assessments annually.
- Fees & assessments: In addition to the annual Replenishment Assessment, owners must pay an Activation Fee and a Replenishment Reserve Fee before a public report can be issued for sale or lease of the property. The Activation Fee is set by CAWCD per unit; the Reserve Fee is based on projected excess groundwater demand.
- Lien for nonpayment: Unpaid Replenishment Assessments, Activation Fees, and Replenishment Reserve Fees, plus interest and penalties, become a continuing lien on the parcel and a personal obligation of the owner at the time they came due.
- Reporting requirements: If an owner delivers groundwater to the property, they must file an annual report with the municipal provider by February 20, detailing amounts delivered to each parcel and total groundwater delivered.
- Amendment process: The declaration may be amended only with written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total area of the property and additional property.
- What this document doesn't cover: This document does not cover typical HOA rules such as architectural standards, pet restrictions, parking rules, or use of common areas. It solely addresses groundwater replenishment obligations.
