What Hopeville's governing documents say
Hopeville is a single-family home subdivision in Buckeye, AZ, governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs) recorded in 1984. These rules run with the land and bind all current and future property owners.
- Livestock, fowl & pets: No livestock or fowl may be raised or kept on any lot, except dogs, cats, other ordinary household pets, or poultry kept only for personal use—no commercial breeding.
- Vehicles & storage: Abandoned, inoperable, wrecked or dismantled vehicles are not allowed on lots unless stored out of sight in a garage/carport or screened from neighbors and streets, and only if being repaired with diligence and made inaccessible to children.
- Structures & dwellings: All buildings must be new construction or of substantially similar condition to adjacent structures. No shacks, and no trailers, RVs, campers, buses, boats, tents, garages, barns, or similar may be used as a temporary or permanent residence.
- Term & amendments: The covenants run for an initial 15 years from 1984, with automatic 10-year extensions unless a majority of lot owners vote to amend or revoke by recorded written instrument.
- Enforcement: Any lot owner can sue to enforce the covenants or recover damages for violations. Mortgage foreclosures do not invalidate these restrictions—purchasers at foreclosure take title subject to them.
