What Farallon's governing documents say
Farallon is a master-planned residential community in Buckeye, Arizona, where you own your individual lot and the Association maintains shared common areas funded by per-lot assessments. All exterior modifications require Design Review Committee approval, which may be denied on aesthetic grounds. The community sits adjacent to active farmland, and by purchasing you acknowledge and legally accept agricultural noise, odor, and dust.
- Architectural control & modification approval: All exterior work requires Design Review Committee approval (45-day review; silence = disapproval) and may be denied on purely aesthetic grounds. Review fees apply; temporary construction structures must be removed within 12 months.
- Residential use; home-based business rules: Exclusive residential use required; home-based businesses allowed only if invisible from outside, no customer visits, no outside employees, and zoning-compliant. Leasing your home is not considered a business.
- Farmland proximity & agricultural operations: Farallon is located near active farmland (generally between Southern Avenue north, Rooks Road east, Baseline Road south, and 263rd Avenue west). By purchasing, you acknowledge and accept all agricultural noise, odor, and dust, and waive legal claims against farmers and the Town of Buckeye.
- Property maintenance & appearance standards: Lots must be kept neat and debris-free. Trash requires Design Review–approved covered containers not visible from neighboring properties; construction equipment must be in approved locations; rooftop HVAC equipment is prohibited; external antennas require Design Review approval.
- No mineral or water extraction: You cannot extract water, oil, minerals, gravel, gas, or earth substances from your lot. A narrow exception exists only for extraction rights conveyed before the first lot sale.
- No temporary residential structures: Trailers, incomplete buildings, tents, and temporary structures may not be used as residences. Temporary construction structures must be removed immediately upon completion, no later than 12 months.
- Assessments and Design Review fees: The Association levies both regular and special assessments per lot for common area maintenance and operations. Design Review Committee review fees apply when you submit modification requests.
