This is a Supplemental Declaration for a 242,586 sq. ft. commercial parcel (Verrado East District Mixed Use Commercial Parcel) in Buckeye, AZ. It binds the Owner/Developer of the parcel to specific use, construction, maintenance, and assessment obligations within the master-planned Verrado community. This document supplements the master Covenants and Declaration recorded in 2002–2003; refer to those documents for the complete regulatory framework.
- Permitted use restrictions: The parcel may only be developed for commercial office purposes for 20 years from December 16, 2017 (through approximately 2037), or until the Founder no longer owns property in Verrado—whichever is earlier—without Founder's written consent. Thereafter, only commercial uses consistent with Town of Buckeye zoning are allowed.
- Assessment obligations & deferral: The parcel is assigned 23 'Equivalent Units' for assessment calculation. However, no assessments are levied until the earlier of (a) 18 months after this Supplemental Declaration is recorded, or (b) issuance of a certificate of occupancy for any building on the parcel.
- Construction & modifications: All construction and modifications require prior written approval from the Commercial Reviewer (designated under the master Declaration). The Reviewer may charge reasonable fees and can require compliance with construction rules, proof of construction insurance, and ongoing insurance coverages.
- Maintenance & landscaping obligations: The Owner must maintain the entire parcel and all landscaping along public rights-of-way according to the master Declaration's Article 3 requirements.
- What this document doesn't cover: This Supplemental Declaration is part of a larger regulatory framework; the master Covenant (recorded April 28, 2003) and Declaration (recorded November 18, 2002) contain additional restrictions, procedures, and enforcement mechanisms. The Owner must comply with both this supplement and those master documents in full.
