What Auza Estates's governing documents say
Auza Estates is a 24-lot rural subdivision in Pinal County, Arizona, governed by a Declaration of Restrictions that runs with the land. There is no homeowners association; these covenants impose rules on property use, construction, livestock, and maintenance, and are enforceable by individual owners. The document does not create any dues or a governing board.
- Construction & minimum home size: Residential structures must be a first-class private dwelling (including modular, double/triple-wide manufactured homes from 1996 or later) with at least 2,000 sq ft of livable floor space (excluding porches, garages, storage). Guest houses must be at least 1,000 sq ft and blend architecturally with the main house. All construction must be completed within one year of start.
- Livestock & farming: Livestock (excluding swine) is allowed only on parcels of 1.5 acres or more, and limited to 20 head per 36-acre parcel. Animals are for personal use, guests, or 4-H activities—not for resale or commercial products. Farming is permitted but must be done tidily, controlling weeds, irrigation, and preventing overflow onto neighbors.
- Vehicles, storage & trash: No junk, rubbish, or obnoxious odors allowed. Disabled or dismantled vehicles cannot be kept. Commercial vehicles, construction equipment, motorhomes, RVs, and utility trailers must be screened or concealed, or housed in a first-class garage or carport. Exterior lighting must not disturb neighbors.
- Fencing & animal enclosures: Perimeter fences for animals must be at least 5 ft and no more than 6 ft high, constructed of quality materials that blend with the main house. Corrals must not be temporary and must match the house's quality and appearance.
- Temporary structures & occupancy: No temporary houses, trailers, or mobile homes (except as allowed residences) may be placed on a lot. No residence may be occupied until fully completed and compliant with all restrictions and county codes.
- Proposed airfield: The document notes that an authorized airfield and runway may be approved along the western boundary (Peart Rd.) in the future, with associated taxiway easements and potential commercial zoning.
- Duration & amendment: The restrictions began in 2000 and automatically extend every 10 years unless owners of 75% or more of the property vote to terminate or change them. If a single entity owns all lots, they may modify or terminate restrictions earlier with lender consent.
