Darimont Ranch is a land-use-covenant property in Cactus Forest, AZ, where owners of parcels within the restricted area must comply with specific design, construction, and land-use rules. The covenant runs for 20 years from 2015 recording (through 2035) and is enforceable by property owners against each other through civil action. There is no HOA or regular assessment system; enforcement is peer-to-peer among property owners.
- Dwelling types & construction standards: Manufactured homes, mobile homes, and geodesic/domed structures are prohibited. Siding must avoid tin; metal roofs are only allowed if copper or factory pre-painted with rectangular ribs. All structures must be neutral, earth-tone, light-pastel, white, or off-white colors—no bright or highly reflective finishes. All construction must be completed within 12 months of the building permit.
- Temporary housing during construction: Mobile homes, RVs, and trailers may be used as temporary housing during construction for up to 12 months from the date the building permit is issued. Temporary living quarters must conform to the color requirements.
- Buffer zone (southern 50 feet): The southern 50 feet of the property is reserved for open space only—no structures, storage, vehicles, or material storage allowed. Vehicular access through the buffer zone is permitted.
- Storage, waste & debris: No dumping, rubbish, or scrap materials may be stored except during active construction. Non-operative or disabled vehicles, boats, trailers, and parts must not be visible from any adjacent road—they must be completely hidden by fencing, building, or vegetation. Any storage causing the property to appear unclean is prohibited.
- Utilities, lighting & equipment: Utilities should be underground wherever practical. All exterior lighting must be shielded so the light source is not visible from adjoining parcels. TV receiving antennas and satellite dishes are permitted for residential use, but must not exceed 5 feet above the highest roof line unless necessary to receive a signal, and may not exceed 24 inches in diameter unless ground-mounted. No commercial radio or television transmission equipment is allowed.
- Animals & livestock: Commercial livestock operations are prohibited. All animals must be contained within property boundaries by fencing and restraints. Excessive noise and barking must be controlled, and the owner must prevent offensive odors and unsightly accumulations. Animals must be confined and are not to be raised for commercial purposes.
- Enforcement & attorney fees: Violations are enforceable through civil action by the declarant and any property owner. The property owner in breach has the right to be notified by certified mail. If litigation is pursued, the losing party must pay all expenses, including reasonable attorney fees, incurred by the other party.
- Grandfather clause: The existing Hay Creek Ranch RV Park use on the property is grandfathered in and deemed compliant with these covenants. Similar quality and style of development and construction expansion is permitted and intended not to be hindered by these restrictions.
