What Goverment's governing documents say
This is a Declaration of Covenants for Government Lots 11 & 14 in Pinal County, Arizona—a land-restricted community where individual parcel owners are bound by recorded restrictions. Unlike an HOA or condominium, there is no shared common area or association; each owner is responsible for maintaining their own parcel and must comply with the covenants. Restrictions are enforceable by the Declarant and other property owners through civil action.
- What you can build: Only site-built permanent dwellings are allowed; no mobile homes, prefabricated structures, or buildings moved from elsewhere. Motor homes or trailers may serve as temporary housing during construction for a maximum of 18 months. All structures must be completed within 18 months of the building permit or ground breaking, and must be set back at least 75 feet from your parcel's property line.
- Domestic animals & horses: Domestic pets and horses are permitted for personal use by owners who have built and occupy a dwelling, but must be confined and kept clean. Commercial livestock is prohibited, and animals may not run free. Owners must eliminate offensive odors and unsightly waste accumulations.
- Vehicles, storage & operations: Non-operative or disassembled vehicles, parts, trailers, and boats cannot be stored on roads and may only be stored on your property if completely hidden by a building, fence, or vegetation. Off-road vehicles, motorcycles, and go-carts may not be operated repetitively (such as racing or circular motion).
- Vegetation & environmental: Saguaro cacti of any size and trees with trunks larger than 2 inches in diameter cannot be removed unless absolutely necessary for construction; if removed, they must be replanted. Disposal of toxic substances (paint, solvents, antifreeze, fuel, oil, cleaning fluids) is prohibited.
- Horse facilities (arenas & corrals): Roping arenas, corrals, and horse training facilities are permitted as long as they meet the 75-foot setback requirement and their combined total does not exceed 30,000 square feet.
- Utilities & lighting: All utilities must be installed underground from their point of origin to your dwelling. Exterior lighting must be shielded, restricted to a maximum height of 12 feet, and positioned so the direct light source is not visible from other parcels. Illuminated arenas are prohibited.
- Enforcement & legal remedies: The Declarant and any property owner can enforce these restrictions through civil action. Violations are declared nuisances and may be enjoined (legally stopped). The losing party in any enforcement lawsuit must pay the other party's attorney fees.
- Duration & amendments: The restrictions automatically expire at the end of calendar year 2030 unless 75% of property owners (by both number and land area) record a written extension. Restrictions can be modified or waived at any time if 75% of property owners execute a written agreement and record it with the Pinal County Recorder.
