Grande Valley Arbor (also referred to as Grande Valley Airport) is an airpark community in Cactus Forest, AZ — a residential airport development where many lots have direct taxiway access. This Declaration of Covenants, Conditions and Restrictions (CC&Rs) establishes rules for all property owners, and is designed to protect and promote aviation activities. There are two associations: the Owners Association (all lot owners) and the Airport Users Association (only owners of Airport Parcels, which have taxiway access).
- Property use & aviation: All lots are subject to an Avigation Easement, granting an unlimited right of flight and allowing associated noise, fumes, and other aviation effects. No use may limit, impair, or adversely affect aviation operations or safety.
- Architectural & improvement review: No improvement or landscaping may be built or altered without approval of both the Architectural Committee and the Airport Users Association. Plans must be submitted and are deemed approved if no decision within 30 days (Architectural Committee) and 10 additional days (Airport Users Association).
- Height & setback restrictions: No improvement may exceed 30 feet in height. Within the Primary Surface (runway protection zone), height is limited to a 7:1 slope from the Primary Surface edge, up to 150 feet above airport elevation. All improvements must comply with Pinal County zoning and airport regulations.
- Two associations & assessments: All lot owners are members of the Owners Association; only owners of Airport Parcels are members of the Airport Users Association. The Owners Association handles architectural control and general CC&R enforcement; the Airport Users Association maintains the airport facilities. Assessments are allocated per acre. Airport Assessments cannot increase more than 5% per year without majority approval of Airport Members.
- Use & maintenance obligations: Each lot must be kept safe, clean, and in good repair. Off-street parking is required for all employees, tenants, and customers. Outside storage (except aircraft parking) must be screened. No businesses that are dangerous, noxious, or involve commercial explosives or radioactive materials. Aviation fuel may only be stored for private use, not commercial sale.
- Enforcement & liens: Violations may be corrected by the association after 10 days (for monetary violations) or 30 days (for other violations), with immediate action allowed for safety-of-flight issues. Unpaid assessments bear 18% interest and become a lien on the property, subordinate to first mortgages.
- Amendment & annexation: The CC&Rs may be amended by a vote of at least 3/4 of Owners Membership Interests (and 3/4 of Airport Members for airport-related provisions). Declarant has the unilateral right to annex or withdraw Additional Parcels until 7 years from recording, and may amend the document before the first parcel sale.
