- Land use & county compliance: All property must be used, improved, and occupied in accordance with Pinal County ordinances.

- Native plant preservation: Native desert plants must be preserved or relocated on the same parcel when possible. Clearing for driveways should circumvent or relocate Saguaros and trees (especially old-growth Saguaros with arms, or Mesquite/Palo Verde trees with trunk diameter ≥4 inches). Selling Saguaros or trees to a commercial entity is prohibited.
- Subdivision & home site limits: Future subdivision of each parcel is limited to a specific maximum number of home sites: Parcel 1 (21.10 acres) – 3; Parcel 2 (24.77 acres) – 3; Parcel 3 (42.09 acres) – no home site less than 5 acres; Parcel 4 (18.06 acres) – 3; Parcel 5 (56.74 acres) – 5.
- Duration & modification: This Declaration runs with the land until January 1, 2010, and automatically extends for three subsequent 10-year periods unless all current owners elect to cancel or amend it.
- Dispute resolution: Any dispute over interpretation or enforcement must be submitted to binding arbitration in Pinal County, Arizona, under the Arizona Superior Court's Uniform Rules of Procedure for Arbitration. The arbitrator's award is final and not subject to appeal.
