- Groundwater replenishment fees: Each parcel is subject to a Replenishment Assessment based on the Parcel Replenishment Obligation, plus Annual Membership Dues. A Replenishment Reserve Fee may also apply (equal to twice the Replenishment Reserve Charge times projected excess groundwater). Activation Fee is a per-unit fee set by CAWCD.
- Payment requirements & timing: The Activation Fee must be paid in full or in two equal installments before issuance of a public report authorizing sale or lease. The Replenishment Reserve Fee must be paid before the public report for parcels qualifying as Category 1 member land. All fees are due to CAWCD.
- Lien & personal obligation: Unpaid Replenishment Assessment and Annual Membership Dues create a continuing lien on the parcel and a personal obligation of the owner at the time the dues came due, with interest, costs, and penalties as provided by law.
- Amendments: This declaration may be amended only by written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total area of the property, or by changes in statutes or regulations.
