What Santo Vallarta's governing documents say
This is a water replenishment covenant for the Santo Vallarta community in Cactus Forest, AZ — not a full set of HOA or condominium rules. It binds all current and future owners of parcels within the property to pay fees and assessments to the Central Arizona Water Conservation District (CAWCD) to satisfy groundwater replenishment requirements under Arizona law.
- Groundwater replenishment obligation: Each parcel within Santo Vallarta is subject to a Parcel Replenishment Obligation, meaning owners must pay annual Replenishment Assessments based on the amount of Excess Groundwater delivered to their parcel. The Declaration ensures the property qualifies as Member Land for an assured water supply certificate.
- Fees and assessments: Owners must pay three types of fees to CAWCD: (1) a Replenishment Assessment (annual, based on water use), (2) a Replenishment Reserve Fee (due before a public report authorizing sale/lease of subdivided land; may be satisfied by assigning long-term storage credits), and (3) an Activation Fee (per-unit fee due before sale/lease of subdivided land). All fees include interest, costs, and penalties if delinquent.
- Lien for nonpayment: Unpaid Replenishment Assessments automatically constitute a continuing lien on the parcel and are also a personal obligation of the owner at the time the assessment came due. CAWCD has all rights and remedies provided by Arizona law to enforce payment.
- What this document doesn't cover: This Declaration deals solely with groundwater replenishment obligations. It does not contain any rules about pets, parking, architectural controls, leasing restrictions (beyond the water-related fees), or typical HOA covenants.
