Cactus Forest is a single-family residential subdivision in Pinal County, Arizona, built on large rural lots (minimum 2.5 acres). You own your individual lot and must comply with strict architectural and use restrictions enforced by an Architectural Committee. This document controls what you can build, how it must look, how you can keep livestock, how vehicles must be parked, and what utilities and equipment are permitted.
- What you own & maintain: You own your individual lot—minimum 2.5 acres (or a 5-acre lot can be split once into two 2.5-acre lots, each no smaller than 2.5 acres). You are responsible for maintaining your lot free of weeds and trash, and for maintaining septic systems until public sewers become available.
- Construction & design requirements: All structures must be new single-family residences with a minimum 2,500 sq ft of livable area. Walls must be vinyl siding, masonry, adobe, or stucco (wood requires Committee approval). All roofs must be tile—no flat roofs. Each residence must have at least one enclosed 2-car garage. Construction must be completed within 9 months, and landscaping within 6 months of occupancy.
- Architectural review & approval: All structures, landscaping, and exterior work must be approved by the Architectural Committee before construction. Submit two copies of complete plans; the Committee has 20 days to approve or disapprove—if no response, plans are deemed approved. Committee decisions are final and not subject to appeal.
- Livestock & animals: Lots are intended for non-commercial raising of horses and other livestock (subject to state and county laws). All animals must be fenced or controlled; animal facilities must be kept clean and use dust control measures, and any arena lighting must be approved by the Architectural Committee so as not to disturb neighbors.
- Fencing requirements: Animal containment fences must be rigid PVC Homopolymer or similar synthetic material with posts in concrete, or 5-foot high pipe fencing with 1-inch railing spacing and four rails (or top rail with 1-inch mesh wire). Chain link may be used for small animals if combined with approved fencing and not visible from the street. No wooden, barbed, or strand wire fencing is allowed.
- Parking & vehicles: Passenger vehicles and light trucks (under 1 ton) may park on the side of your lot if they meet dwelling setback requirements and are approved by the Committee. Campers, horse trailers, motor homes, and boats may park on the back if attractively screened and approved. All other vehicles must be in a garage or barn. Vehicles under repair or not in operating condition must be enclosed.
- Utilities & equipment screening: All gas, electric, power, telephone, water, sewer, and cable lines must be placed underground unless law prohibits it. Air-conditioning and refrigeration equipment must be screened or concealed as part of the building's integrated design (subject to Committee approval). Satellite dishes must be screened so they are not visible from the street or neighboring property.
- Enforcement & penalties: Violations can be enforced by other owners or the Declarant through injunctive relief, damages, or abatement. If you fail to comply with cleanup orders within 10 days of written notice, the Committee may enter and clean your lot up to four times yearly, with costs charged to you as a lien. The successful party in any proceeding can collect all expenses, court costs, attorneys' fees, and damages with 18% per annum interest.
