Sharon On The Greens is a planned community in Cactus Forest, Arizona, where you own your individual lot in fee simple. The association manages common areas and enforces community standards through covenants and regulations. Residents pay a one-time $500 assessment at closing, annual assessments, and monthly maintenance fees.
- What you own & maintain: You own your lot and residence; the association maintains common areas (landscaping, roads, sidewalks, gates). Interior maintenance—your roof, plumbing, HVAC, and all contents—are your sole responsibility. The association is not responsible for any interior elements of your unit.
- Assessments and fees: A one-time $500 assessment is due at closing. Annual assessments start at a maximum of $125 in the first year, then automatically increase with the Consumer Price Index (or higher by 2/3 member vote). Monthly maintenance fees are due by the 5th of each month; a $10 late fee applies after the 10th. If 60+ days past due, the entire year's assessments become immediately due. Unpaid assessments create liens subject to foreclosure.
- Pets: Maximum two (2) household pets per residence, each no larger than 15 inches at the shoulder or 25 pounds (pets exceeding this as of March 2004 are grandfathered but cannot be replaced). Pets must be leashed on common areas, and owners are personally liable for any damage their pets cause.
- Vehicles & parking: Maximum two vehicles per unit: one garage and one assigned uncovered space. Prohibited: trucks over 3/4 ton, commercial vehicles, campers, trailers, boats, and recreational vehicles. A vehicle left in the same location for 7+ days is considered in storage and prohibited. No engine maintenance or repairs are allowed on common areas.
- Architectural review & exterior alterations: All exterior changes—paint, landscaping, fences, satellite dishes, screen doors, skylights, and any alteration affecting the building's appearance—require prior Board approval. Submit detailed plans to the management company; if the Board does not respond within 30 days, approval is automatically deemed granted. You must maintain approved alterations in good repair and in harmony with the community.
- Leasing & rentals: You may lease your residence to a single family. All leases must be in writing and a copy provided to the management company. Leases must include the association's bylaws, declaration, and rules, binding renters to comply. You remain responsible for your tenants' and guests' compliance with community rules.
- Rules enforcement & penalties: First violation: written notice. Second violation: $20 fine. Third violation: $50 fine. Fourth and subsequent violations: legal action, liens, or injunctions (violator pays all costs and attorney fees). Non-enforcement at any time does not waive future enforcement.
- Noise, disturbance & children: No disturbing noises permitted in residences or common areas. Sound systems and instruments must be kept at levels that don't disturb neighbors. Power tools in garages are prohibited between 9 p.m. and 9 a.m. Children must be supervised so they don't disturb neighbors, and parents are responsible for their children's actions and toys on lawns.
