This document is a supplemental declaration that makes each lot in Sierra Entrada Garden Homes, Unit II, Tract B, a member of the Central Arizona Groundwater Replenishment District. It imposes a mandatory annual assessment (the Replenishment Assessment) on each parcel to fund groundwater replenishment. This is not a typical homeowners' association rulebook; it addresses only water-related obligations.
- Replenishment Assessment: Each parcel is subject to an annual assessment levied by the Central Arizona Water Conservation District (CAWCD) based on the parcel's groundwater use. The amount is determined by CAWCD and may change over time.
- Lien and Personal Obligation: The assessment, plus interest and penalties, is both a continuing lien on the parcel and a personal obligation of the owner at the time the assessment came due. Nonpayment gives CAWCD the rights and remedies provided by Arizona law.
- Amendment Threshold: This declaration can be amended or revoked only by written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total area of the property, or by changes in applicable statutes or regulations.
- Binding Effect: The covenants run with the land and bind all current and future owners and successors. By accepting a deed, every owner agrees to pay the assessments and comply with the declaration.
- What this document doesn't cover: This declaration does not cover typical HOA or condo rules such as architectural controls, pet policies, leasing restrictions, parking, or maintenance responsibilities. It only governs groundwater replenishment obligations.
