What Sunscape Estates's governing documents say
This is the Bylaws of Sunscape Estates Homeowners Association, a standard single-family HOA in Cactus Forest, AZ. The Bylaws govern the association's operations — meetings, board, elections, and assessments — but the full property rules are in the Declaration (CC&Rs) and Articles of Incorporation, which control over these Bylaws. The association also goes by Wild Horse Homeowners Association.
- Meeting & voting rules: Annual meetings are held the third Saturday of January at 1:00 PM. Special meetings can be called by the president, the board, or upon written request of members holding 1/4 of the votes. Written notice must be given at least 30 days before the meeting. A quorum is 50% of the votes entitled to be cast. Members may vote in person or by proxy.
- Board of Directors & officers: The board has 3–9 members, all association members (except Declarant's representatives). Directors serve staggered 3-year terms and can be removed with or without cause by a majority vote of members. Officers (president, VP, secretary, treasurer) are elected annually from the board and may be removed by the board. No director receives compensation.
- Assessments & liens: Each member must pay annual and special assessments as provided in the Declaration. Assessments not paid within 30 days after the due date bear interest at 6% above the prime rate and may be collected by lien foreclosure or personal lawsuit, with costs and attorney's fees added. Nonuse of common area or abandonment does not waive assessment liability.
- Rules & enforcement: The board may adopt rules for common area use and personal conduct, with penalties for infractions. Voting rights and use of recreational facilities may be suspended during any period a member is delinquent on assessments, or for up to 60 days after notice and hearing for rule violations.
- Committees: An Architectural Control Committee is appointed as provided in the Declaration. A Nominating Committee (chair from board plus two or more members) nominates candidates for the board; nominations may also be made from the floor.
- Amendments & governing documents: These Bylaws may be amended by a majority vote of a quorum of members at a regular or special meeting. In case of conflict, the Articles of Incorporation control over the Bylaws, and the Declaration controls over both. The Declaration (CC&Rs) is recorded separately and contains the full property restrictions and assessment details.
- What this document doesn't cover: These Bylaws do not contain the specific rules homeowners must follow — such as architectural guidelines, pet limits, leasing restrictions, parking rules, or age restrictions. Those are in the separate Declaration of Covenants, Conditions, and Restrictions (CC&Rs). This document focuses on association governance only.
