Tesoro Townhomes is a townhome community in Cactus Forest, Arizona (within the Gold Canyon master-planned community), where you own your individual dwelling unit and lot subject to shared party walls with neighbors and common-area maintenance by the homeowners association, funded by per-lot annual assessments and a one-time working capital contribution at purchase.
- What you own & maintain: You own your dwelling unit and lot. You're responsible for your unit's interior, roof, foundation, landscaping within your lot, driveway and patios, and all interior utility lines. The association maintains common areas, roads, parking, pools, exterior building surfaces (not roofs), landscaping outside dwelling-unit walls, and utilities serving common areas.
- Party walls (shared walls with neighbors): Walls between adjacent units are shared equally by both owners. If the wall is damaged by your negligence or acts of your family, guests, or tenants, you alone pay to repair it. If damage results from ordinary wear or deterioration (not your fault), repair costs are split equally among all owners whose properties adjoin that wall.
- Assessments & fees: Annual assessments are levied per lot (amounts determined by Board). New owners also pay a one-time, non-refundable working-capital contribution equal to 1/6 of the annual assessment. Special assessments require 51% member vote. Delinquent assessments accrue 18% annual interest and create a lien that can lead to foreclosure.
- Architectural review: All exterior work—buildings, structures, landscaping, fences, HVAC, solar panels, paint, and any modification affecting exterior appearance—requires Architectural Control Committee approval under adopted Guidelines. During development, the declarant appoints the committee; thereafter the Board appoints it.
- Insurance: The association maintains hazard insurance (fire, extended coverage, vandalism) and comprehensive liability insurance with a $1,000,000 minimum per occurrence on common-area improvements, funded from assessments. Owners are responsible for their own unit and personal-property insurance.
- Governance & voting: Each lot owner is automatically a member with one vote per lot. During the developer phase, the declarant holds enhanced voting power (3× normal votes) and appoints the Architectural Committee. After five years or when developer control ends, the Board (3–7 members, elected by owners) takes full authority.
- Master community & subordination: Tesoro is a Village Declaration within the Gold Canyon master-planned community and subordinate to its master declaration. Some Board decisions (such as road reserve funding) require Master Association approval.
