The Reserve at Tranquil Trail is a single-family home HOA in Carefree, AZ. Each homeowner owns their lot and house; the association maintains common areas and certain landscape tracts. The declaration sets rules for property use, architectural review, assessments, and enforcement. This document applies to all lot owners, residents, and their guests.
- Membership & voting: Every lot owner is a member with one vote per lot. The developer (Declarant) held 20 votes per lot until certain events (e.g., when Class A votes equaled Class B, or by Dec. 31, 2011). Owners in violation of governing documents cannot serve on the Board or committees.
- Assessments: Annual assessments fund common area maintenance, reserves, and administration. The maximum annual assessment can increase up to 25% each year without a vote; a majority vote allows higher increases. Special assessments for capital improvements require 2/3 of votes cast. Assessments are a lien on the lot and personal obligation of the owner.
- Architectural review: Any exterior improvement visible from neighboring property (including buildings, fences, landscaping, color changes) must be approved in writing by the Design Review Committee. The committee has 45 days to act; if not approved/disapproved within that time, approval is deemed given. Fees and deposits may be charged.
- Use restrictions: Lots are for single-family residential use only. No trade or business, but limited home-based businesses are allowed if not detectable from outside. No animals except reasonable domestic pets; no structures visible from neighboring property for pets. No antennas, satellite dishes, or flagpoles over 16 ft without approval. Basketball goals are not allowed in front yards. Parking must be in garages or driveways; no recreational vehicles or boats visible from street or neighboring property. No trailers, sheds, or temporary structures used as residences. Trash containers must be hidden except on collection days.
- Maintenance obligations: Owners must maintain their lots, including all landscaping, walls, fences, and buildings in good condition. The association maintains common areas and areas of common responsibility (e.g., entry walls, signage, bridge headwalls). Owners are responsible for keeping front yards landscaped and free of weeds, and must complete front landscaping within 90 days of certificate of occupancy. The association may enter a lot to maintain drainage or landscaping if the owner fails to do so.
- Enforcement & penalties: The association may impose monetary penalties for violations after notice and a hearing. Unpaid penalties accrue late charges and interest (12% per annum). The association can sue to collect or foreclose its lien. The declaration runs with the land and is enforceable by the association or any owner.
