What Elaine Farms's governing documents say
This document is a Declaration of Covenants, Conditions and Restrictions for Elaine Farms, a residential development in Casa Grande, AZ, that establishes the property as 'Member Land' in the Central Arizona Groundwater Replenishment District. It binds all current and future parcel owners to pay certain water-related fees to CAWCD, a political subdivision of Arizona, and imposes liens for nonpayment. This is not a standard homeowners' association rulebook; it covers only groundwater replenishment obligations.
- Replenishment Assessment: Each parcel is subject to an annual Replenishment Assessment based on its Parcel Replenishment Obligation. The amount is determined by CAWCD and levied in accordance with Arizona law. Nonpayment results in interest, costs, penalties, and a continuing lien on the parcel.
- Activation Fee: An Activation Fee must be paid by the owner to CAWCD before the state real estate commissioner issues a public report authorizing sale or lease of subdivided lands within the owner's portion of the property. The fee is calculated per housing unit as set by CAWCD's board.
- Replenishment Reserve Fee: A Replenishment Reserve Fee applies to parcels that qualify as Category 1 member land. It must be paid before issuance of a public report, though long-term storage credits may be assigned in lieu of payment. Category 2 parcels are exempt.
- Lien and Personal Obligation: The Replenishment Assessment, Activation Fee, and Replenishment Reserve Fee constitute a continuing lien on each parcel and a personal obligation of the owner at the time the assessment came due. CAWCD has the rights and remedies provided by Arizona Revised Statutes § 48-3778 for nonpayment.
- Amendments: This declaration may be modified, amended, or revoked only by express written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total area of the property, or by amendment of relevant statutes or regulations.
- Binding Effect: By accepting a deed or acquiring any interest in the property, each owner is bound by all covenants, conditions, and restrictions in this declaration, which run with the land and bind all successors and assigns.
- What this document doesn't cover: This document does not address typical community rules such as pet restrictions, leasing, parking, architectural standards, or maintenance obligations. It is solely focused on water replenishment membership requirements.
