What G Diamond Ranch's governing documents say
This document is a water district covenant for G Diamond Ranch Parcel 'C' in Casa Grande, AZ — not a standard HOA rulebook. It makes each parcel in the subdivision a member of the Central Arizona Groundwater Replenishment District (CAWCD) and obligates owners to pay special fees for groundwater replenishment to ensure the property qualifies for a certificate of assured water supply. The rules bind all current and future property owners.
- Groundwater Replenishment Obligation: Each parcel is subject to a Parcel Replenishment Obligation — the amount of groundwater delivered to the parcel times the percentage of that year's excess groundwater for the entire Property. This obligation triggers annual assessments.
- Fees: Replenishment Assessment: An annual assessment levied by CAWCD against each parcel, based on the Parcel Replenishment Obligation. Amount is set by CAWCD. Includes a Replenishment Reserve Charge that is part of the assessment.
- Fees: Activation Fee: A one-time fee equal to the per-unit fee set by CAWCD's board multiplied by the total number of housing units on the owner's portion of the Property. Must be paid before a public report for sale or lease of subdivided lands is issued.
- Fees: Replenishment Reserve Fee: A fee equal to twice the Replenishment Reserve Charge multiplied by the total projected annual excess groundwater demand for the entire G Diamond Ranch Parcel 'C'. Must be paid before a public report is issued. Can be satisfied by assigning long-term storage credits instead of cash.
- Lien and Personal Obligation: The Replenishment Assessment, plus interest, costs, and penalties, constitutes a continuing lien on the parcel and is also a personal obligation of whoever owned the parcel when it came due. CAWCD has the rights and remedies under Arizona law for nonpayment.
- What this document doesn't cover: This declaration only addresses water replenishment fees and obligations. It does not contain typical HOA rules on pets, leasing, parking, architectural review, common area maintenance, or any other community restrictions.
