Desert Foothills North is a single-family home HOA in Cave Creek, AZ. The CC&Rs apply to all lot owners and residents, setting rules for construction, lot use, livestock, and assessments to protect property values and the neighborhood's character.
- Architectural review: All structures require prior written approval from the Architectural Committee, with plans submitted at least 30 days before construction. Approval is deemed granted if no response within 45 days, provided the design complies with all restrictions.
- Building restrictions: Only one detached single-family home (minimum 1,500 sq ft ground floor area), plus optional guest house (minimum 400 sq ft), garage/carport (minimum 20x24 ft), barn, and tack/storage building allowed. Setbacks: 50 ft from street, 20 ft from side lot lines. No roof-mounted appliances visible from street or neighbors (except antennas per FCC rules).
- Fencing & landscaping: Front fences or solid walls cannot exceed 2.5 ft in height; side and rear fences up to 6 ft. Hedges taller than 3 ft cannot be within 52 ft of the front lot line. No laundry lines visible from adjacent lots.
- Lot use & businesses: Lots are for residential use only. Home-based businesses are allowed only if not detectable from outside (no sight, sound, or smell), comply with zoning, involve no customer visits or solicitation, and do not create a nuisance. No temporary structures (trailers, tents, etc.) used as residences.
- Livestock: Only horses, mules, and donkeys are allowed, with a maximum of two per lot. Stables and corrals must be at least 75 ft from any adjacent home or pool, confined to the rear half of the lot, and kept clean (manure in covered containers, insect control).
- Parking & storage: RVs, boats, campers, and inoperable vehicles stored outside must be placed near the rear yard and screened from street view (e.g., fence or shrubbery). Visiting guests in self-contained RVs are limited to 21 days per 12-month period.
- Assessments & fees: Annual assessment was $30 in 2006, due April 1, delinquent after May 1 with a $5 monthly late fee. The board may increase assessments only by majority vote of owners. A one-time transfer fee of $100 is due upon sale or transfer of a lot. Delinquent assessments become a lien.
- Enforcement: The association or any owner may enforce the CC&Rs. The owner responsible for a violation must pay all attorney fees and costs incurred by the association, even without a lawsuit, and these become an assessment lien.
