What San Marcos Square's governing documents say
San Marcos Square is a commercial property development in Chandler, AZ — not a residential community. This Declaration governs the lots (owned by businesses or investors) and establishes reciprocal easements, common area maintenance obligations, and use restrictions for a first-class retail and office center.
- Permitted & restricted uses: Lots may only be used for commercial purposes such as retail, professional offices, restaurants, and service stations. Prohibited uses include pawn shops, adult entertainment, auction sales, outdoor storage (except as approved), and any activity that creates a nuisance or violates environmental laws.
- Common area maintenance & cost sharing: The Developer (or successor) maintains the Common Area (private drive, parking, landscaping, lighting, etc.). Each Obligated Owner pays its Pro Rata Share of Common Expenses based on lot square footage. Delinquent payments accrue 12% interest and become a lien on the lot.
- Architectural control: No structures, landscaping, or alterations may be built without Developer's prior approval of plans. Approval is not unreasonably withheld, and plans are deemed approved if no response within 30 days. Developer may adopt design guidelines.
- Parking & loading: All loading and heavy traffic areas must be screened from view. Parking areas within the Common Area are subject to easements for reasonable use, but Developer may designate exclusive parking for specific lots.
- Insurance & indemnification: Each Owner must carry comprehensive general liability insurance with at least $1,000,000 combined single limit. Owners indemnify each other for claims arising from their lot (except common area). A waiver of subrogation applies to insured losses.
- Environmental regulations: No hazardous substances may be generated or released on any lot except in full compliance with federal and state laws. Owners must indemnify others for environmental claims resulting from their breach.
- Enforcement & remedies: Developer and any Owner may seek injunctive relief or use self-help (with 30 days' notice and approval of 2/3 of lots) to cure violations. Unpaid assessments and self-help costs become liens enforceable like mortgages.
