Clearwater Farms Unit IV is a residential/farming subdivision in Citrus Park, AZ, governed by this Declaration of Conditions, Covenants and Restrictions (CC&Rs). It creates a property owners' association (Clearwater Farms IV and V Property Owners Association) that manages a shared irrigation system and interior roadways. As a lot owner, you are automatically a member and must pay assessments for water and road maintenance, and you may use your lot for residential or farming purposes subject to specific rules.
- What you own & maintain: You own your lot and an undivided interest in the irrigation system. You are responsible for paying assessments to the association for irrigation system and roadway maintenance, as well as water charges to Maricopa Water District.
- Use restrictions: Lots may be used for residential or farming purposes only. Minimum residence size is 1,600 sq ft; mobile homes are prohibited as residences. No commercial or retail businesses allowed.
- Architectural review: All plans for structures (including residences, barns, outbuildings, fences) must be approved by the Architectural Control Committee or the association. Approval is automatic if no decision within 45 days of submission.
- Animals: Maximum 4 adult dogs and 4 adult cats per residence; no more than 2 exotic family pets. Livestock allowed: no more than 4 large animals per acre, 50 poultry/fowl per acre, 50 small meat/fur animals per acre. Hogs and swine prohibited. Animals must be fenced or leashed, and husbandry must not create nuisances.
- Irrigation & water rights: Each lot is entitled to a share of irrigation water in proportion to acreage, subject to payment of water charges and assessments. The association controls water delivery timing and volume. Non-paying owners lose water rights.
- Assessments: The association levies annual and special assessments for irrigation system and roadway maintenance, based on acreage owned. Assessments are due as determined by the board; delinquencies accrue interest at 18% per annum and may result in liens and loss of water rights.
- General restrictions & maintenance: Lots must be kept free of weeds, trash, and non-operating vehicles. No temporary structures (trailers, tents) as living quarters beyond 6 months without approval. Signs limited to one 2x3 ft of sale or farm/family name. The association may enter lots to cure violations and charge the owner.
- Enforcement & amendments: The declaration runs with the land and can be enforced by any owner or the association via injunction, specific performance, or nuisance abatement. Violators may also lose water rights. Attorney fees recovered. Amendments require 75% of acreage owners' written consent and recording.
