Montana Blanca Estates is a single-family home subdivision in El Mirage, Arizona, governed by a homeowners association (HOA). All property owners automatically become members of the association and must comply with this Declaration of Covenants, Conditions and Restrictions. The rules are designed to maintain property values and a uniform residential character.
- What you own & maintain: You own your lot and detached single-family residence (max 2 stories) and are responsible for its maintenance, including landscaping and exterior repairs. The association maintains the common areas (tracts, landscaping in rights-of-way, etc.) and may also maintain certain party walls and adjacent walls.
- Leasing & rentals: All leases must be in writing, for the entire residence and lot, with a minimum term of 30 days. Short-term rentals (less than 30 days) are prohibited.
- Pets: Only common household pets (dogs, cats, or others approved by the board) are allowed, in reasonable numbers (no specific cap), and not for commercial purposes. Pets must be kept in a fenced yard or on a leash, and structures like kennels must not be visible from neighboring property.
- Parking & vehicles: Vehicles should be parked in garages or driveways; street parking is allowed temporarily but overnight on-street parking is prohibited. No trucks over 1 ton, recreational vehicles, boats, or commercial vehicles may be visible from neighboring property or common areas. Inoperable or unlicensed vehicles are not allowed. Towing is permitted for violations.
- Architectural control: Any exterior changes (construction, landscaping, paint, signs, etc.) require prior written approval from the Architectural Committee. If the committee does not respond within 60 days, approval is deemed granted. This applies to all improvements, including fences, sheds, and antennas.
- Assessments & fees: All owners pay annual and possible special assessments. The initial maximum annual assessment was $420, automatically increasing each year by the greater of 10% or CPI-based adjustment (with a 20% annual cap without majority approval). A transfer fee (set by board) is due from each new owner, plus a one-time reserve fee equal to 2 months' assessments for the first purchaser of a new residence.
- Use restrictions: Lots must be used only for single-family residential purposes. Home businesses are allowed only if permitted by municipal ordinances. No noxious activities, nuisance, or anything interfering with quiet enjoyment. Signs are limited (one temporary 'for sale' sign up to 5 sq ft, one identification sign up to 80 sq in, etc.).
- Enforcement & fines: The association may impose fines for violations after a written warning with at least 10 days to cure. Unpaid fines become a lien on the lot. The association can also suspend voting rights and common area use for delinquent assessments (after 15 days) or other infractions (up to 60 days).
