What Parkview Plaza Condominiums's governing documents say
Parkview Plaza Condominiums is a three-unit commercial condominium in Fort McDowell, AZ restricted to office and storage use. Unit owners own their individual units and share ownership of common elements maintained by the association through per-unit assessments allocated by square footage.
- What you own & maintain: You own your unit's interior (finished surfaces, fixtures, and utilities serving only your unit); the association maintains common structure, roof frames, and shared systems. Unit owners are responsible for the roof portion above their unit and interior maintenance.
- Governance & voting: Each unit holds one vote regardless of size. The developer controls board appointments during the "Period of Declarant Control" (ending 90 days after 75% of units are sold or 4 years after sales cease); afterward, unit owners elect a board of at least three members, a majority of whom must be unit owners.
- Leasing & rentals: Units may be leased but only in their entirety—no partial leases or subleasing permitted. All leases must be in writing and subject to the declaration and rules. Unit owners must notify the association at least 10 days before lease commencement with lessee names and emergency contact information; owners remain liable for lessee violations.
- Use restrictions (office and storage only): Units are restricted exclusively to "normal and customary office and storage purposes" conforming to zoning—this is a commercial condominium, not residential. No residential occupancy is permitted.
- Parking & vehicles: Each unit is allocated three uncovered parking spaces. Motor vehicles may only be parked in assigned spaces; no mobile homes, trailers, campers, boats, or inoperable vehicles are permitted anywhere on the property.
- Pets & animals: No animals of any kind—including birds, reptiles, fowl, poultry, or livestock—may be kept in units or anywhere on the property.
- Alterations & improvements: Non-structural alterations inside units are allowed without approval, but owners are liable for damage to common elements. Structural alterations and anything visible from the building's exterior require prior Board approval; structural work also requires certification by a licensed Arizona architect or engineer.
- Assessments & fees: Assessments cover maintenance, operation, and repair of common elements and are allocated proportionally by unit square footage: Unit A and C pay 33.667% each; Unit B pays 32.667%. The Board adopts an annual budget at least 30 days before each fiscal year.
