Ashbrook Condominiums I is a two-unit condominium in Fountain Hills, Arizona, where you own your individual unit interior and share ownership of the building structure and common grounds. Most decisions about work on your unit—structural alterations, exterior modifications, visible solar or satellite equipment, and vehicle maintenance—require written approval from the adjacent unit owner with whom you share a party wall.
- What you own & maintain: You own your unit interior and must maintain it at your expense. The association maintains the building structure, roof, and common elements; if the association fails to maintain common elements, you're responsible for the area adjoining your unit.
- Alterations to your unit: Nonstructural interior changes require no approval. Structural work, exterior modifications, and changes to exterior color or texture require prior written approval from the adjacent unit owner before you begin.
- Exterior & vehicle restrictions: Solar panels, satellite dishes, antennas, and similar devices cannot be visible from neighboring property without the adjacent unit owner's written consent. Vehicle repair, reconstruction, or servicing is prohibited if visible from neighboring property; inoperable vehicles cannot be stored if visible.
- Use restrictions: Single-family residential use only—no business, trade, occupation, or non-residential activity. Outside clotheslines are prohibited. Exterior sound devices (speakers, horns, whistles) are not permitted except for security or emergency purposes.
- Insurance: You must maintain fire and casualty insurance on your unit for its full replacement value. Liability insurance of $500,000 minimum is required, held jointly with the adjacent unit owner.
- Assessments: Common expenses are assessed equally per unit.
- Duration & governance: The declaration runs 20 years initially, then automatically renews for successive 10-year periods. The original declarant controls the board until 90 days after all units are sold to non-declarant owners; thereafter unit owners elect the board.
